Pray Pray – Terms and Conditions

1. Acceptance of Terms

By accessing or using Pray Pray ("we," "our," "the Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, you must immediately discontinue use of the Platform.

透過使用 Pray Pray（以下簡稱「本平台」），即表示您同意遵守本《使用條款》（Terms）。若您不同意，請立即停止使用本平台。

2. Scope of Services

Pray Pray is a temple search and listing platform that provides:

• Search, browsing, and viewing of temple information.
• Member registration.
• Temple owners and service providers the ability to create and manage profiles.
• User-generated content (UGC), including comments, photos, and videos.
• Optional paid features, such as Proservices, advertisements, and premium memberships.
• From time to time, marketing or promotional campaigns, including but not limited to gift sponsorships, giveaways, or content promotions in collaboration with temples or service providers. Such campaigns are strictly for marketing purposes and do not imply ownership, operation, or control of temple activities. Distribution of sponsored items is solely the responsibility of the participating temple or service provider.

本平台是一個 寺廟搜尋與列表平台，提供以下功能：

• 搜尋、瀏覽與查看寺廟資訊
• 用戶註冊
• 寺廟主及服務提供者可建立與管理檔案
• 用戶生成內容（UGC），包括留言、照片、影片
• 可選付費功能，如 專業服務、廣告、會員制
• 本平台可能不時舉辦 行銷或推廣活動，包括但不限於禮品贊助、抽獎或與寺廟合作之內容宣傳。此類活動僅屬行銷用途，並不表示本平台擁有、經營或控制寺廟活動。贊助物品之派發完全由參與寺廟或服務提供者自行負責。

3. User Eligibility

• You must be at least 18 years old to use Pray Pray. Users under 18 must obtain parental or guardian consent.
• You are solely responsible for ensuring that your use complies with applicable local laws.

使用資格：

• 您必須年滿 18 歲方可使用本平台。未滿 18 歲者須取得監護人同意。
• 您需自行確保使用符合所在地法律。

4. Account Responsibilities

• Provide accurate and truthful information during registration.
• Keep your account credentials secure.
• Do not share or transfer accounts.
• We may suspend or terminate accounts for violations of these Terms.

帳號責任：

• 註冊時必須提供正確資訊。
• 您需自行妥善保管帳號。
• 不得共用或轉讓帳號。
• 若違反本條款，本平台可暫停或終止帳號。

5. User-Generated Content (UGC)

• You retain ownership of your UGC but grant Pray Pray a non-exclusive, royalty-free, worldwide, transferable, sub-licensable license to use, reproduce, distribute, and display such content for operating and promoting the Platform.
• You represent and warrant that you own the rights to your content and that it does not infringe on third-party rights.
• Prohibited UGC includes but is not limited to illegal, defamatory, obscene, hateful, discriminatory, misleading, or infringing content.
• We may remove or restrict access to UGC at our sole discretion.

UGC 條款：

• 您保留內容所有權，但授予本平台 非獨占、免版稅、全球可轉授權之使用權，用於平台營運與推廣。
• 您保證擁有內容之合法權利，且不侵犯第三方。
• 禁止內容包括但不限於違法、誹謗、猥褻、仇恨、歧視、誤導或侵權。
• 本平台可自行決定刪除或限制內容。

6. Intellectual Property

• All rights to the Platform, including trademarks, logos, software, design, and data (excluding UGC), belong to Pray Pray.
• Unauthorized reproduction, modification, distribution, or exploitation is prohibited.

智慧財產權：

• 除 UGC 外，本平台相關權利（商標、標誌、軟體、設計、資料等）均屬 Pray Pray 所有。
• 未經授權不得複製、修改、散佈或利用。

7. Paid Services

• Some features (e.g., Proservices, ads, premium memberships) may require payment.
• Fees are non-refundable unless otherwise required by law.
• Pray Pray is not responsible for any disputes, dissatisfaction, or damages resulting from paid services offered by third parties.
• We may modify pricing or billing terms with reasonable notice.

付費服務：

• 某些功能需支付費用（如專業服務、廣告、會員制）。
• 除法律要求外，費用不予退還。
• 本平台不對任何第三方提供之付費服務所引起之爭議、不滿或損害負責。
• 本平台可隨時調整收費並公告。

8. Privacy

• Your use of Pray Pray is governed by our Privacy Policy, which describes data collection, use, and protection.
• By using the Platform, you consent to our data practices as outlined in the Privacy Policy.

隱私：

• 使用本平台即表示您同意我們的 隱私政策，其中說明資料收集、使用與保護方式。
• 使用即視為同意依隱私政策處理資料。

9. Disclaimers and Limitation of Liability

1. General Disclaimer

Pray Pray is a platform for temple listings, cultural information, and service provider profiles. We do not own, operate, or control any temples or services offered by third parties. We make no guarantees regarding the accuracy, reliability, completeness, legality, or availability of any information, listings, services, or user-generated content.

2. Third-Party Services and Transactions

• We are not a party to, nor responsible for, any agreements, communications, or disputes between users, temples, or service providers.
• Any services, rituals, consultations, or products obtained through the Platform are solely the responsibility of the temple or service provider.
• We do not endorse, guarantee, or assume liability for the quality, legality, or effectiveness of third-party services.

3. Marketing and Promotional Campaigns

• From time to time, Pray Pray may conduct campaigns such as gift sponsorships or promotional collaborations with temples.
• These campaigns are solely for marketing purposes. Distribution of items or execution of activities rests entirely with the participating temple or provider.
• We disclaim all liability for disputes, damages, or dissatisfaction arising from such campaigns.

4. User Assumption of Risk

By using the Platform, you acknowledge that you are solely responsible for evaluating the accuracy and appropriateness of any services or information. We are not liable for any loss, injury, or damages from reliance on third-party content or services.

5. Technical Limitations

We do not guarantee uninterrupted access. We are not liable for service outages, errors, data loss, security breaches, or harmful components such as malware.

6. Limitation of Liability

• To the fullest extent permitted by law: Pray Pray shall not be liable for any direct, indirect, incidental, consequential, punitive, or special damages, including but not limited to financial loss, reputational harm, lost profits, data loss, personal injury, or emotional distress.
• Total liability for any claim shall not exceed the greater of: (a) the fees paid by you to us in the past twelve (12) months, or (b) HKD 100.

7. Indemnification

You agree to indemnify and hold harmless Pray Pray, its affiliates, employees, and partners from any claims, damages, or expenses arising from: (i) your breach of these Terms, (ii) your misuse of the Platform, or (iii) any disputes with temples, service providers, or other users.

10. Termination

We may suspend or terminate accounts for violations. Users may delete accounts at any time.

帳號終止：

• 若違反條款，本平台有權終止帳號。
• 用戶可隨時要求本平台刪除帳號。

11. Changes to Terms

We may modify these Terms at any time. Continued use after updates constitutes acceptance.

條款修改：

• 本平台可隨時修改條款，並公告更新。
• 修改後繼續使用即視為同意。

12. Governing Law and Jurisdiction

These Terms are governed by the laws of Hong Kong. Disputes shall be subject to the exclusive jurisdiction of Hong Kong courts.

法律管轄：

• 本條款受 香港法律 管轄。
• 爭議由 香港法院 管轄。
